Terms of service
1. Scope
These General Terms and Conditions (GTC) apply to all orders and deliveries of products made via the online shop of AlpinePeak GmbH, Hauptstrasse 11, 8783 Linthal, Switzerland.
2. Conclusion of contract
The purchase contract is concluded as soon as the customer places an order in the online shop and this order is confirmed by AlpinePeak GmbH by email with an order confirmation. This order confirmation constitutes acceptance of the offer.
3. Prices and shipping costs
All prices are stated in Swiss francs (CHF) including value added tax. Shipping costs are calculated separately and shown clearly during the ordering process. Price changes and errors remain reserved.
4. Payment terms
Payment can be made by credit card, TWINT, PayPal, bank transfer, purchase on account (PowerPay) or other payment methods offered during the ordering process.
If the payment method “purchase on account” is selected, the claim is assigned to MF Group AG (PowerPay). Payment must be made exclusively to MF Group AG. The GTC of MF Group apply, including the provisions on reminder fees and credit checks.

5. Delivery
Delivery is made to the delivery address provided by the customer. Delivery times are stated in the online shop. Delays may occur in particular due to shipping service providers or other third parties. To the extent that such delays are not attributable to AlpinePeak GmbH, AlpinePeak GmbH accepts no liability for them. Partial deliveries are permitted insofar as they are reasonable for the customer.
6. Retention of title
The delivered goods remain the property of AlpinePeak GmbH until the purchase price has been paid in full.
7. Returns and withdrawal
MISAKI grants you a voluntary 30-day return policy. The period begins on the day on which you or a third party designated by you received the goods.
If you would like to register a return or withdrawal, please inform AlpinePeak GmbH in writing, preferably by email at info@misaki-knives.ch. If possible, include the order number, your name and the products concerned. Please contact us before returning the goods so that we can correctly assign your request and send you the next steps as well as the free return label.
The return shipment is made by post. The return shipment is free of charge for you. MISAKI covers the cost of the return shipment and provides you with a free return label to download and print. The return address is shown on the return label.
For voluntary returns, we accept new, unused products in their original packaging. The goods must be returned complete and in perfect condition. Statutory claims for defective goods remain unaffected.
Personalised products are excluded from the return policy. This includes, in particular, products with engraving or other individually made items, provided there is no defect.
After receiving and checking the return shipment, we will refund the purchase amount of the returned products using the original payment method. Processing may take a few working days depending on the payment provider.
Mandatory statutory claims, in particular for defective goods, remain unaffected.
8. Warranty and liability
The statutory warranty rights apply. AlpinePeak GmbH has unlimited liability for damage caused by intent or gross negligence. In all other respects, liability is excluded to the extent permitted by law. Liability for indirect damage and consequential damage is excluded to the extent permitted by law.
9. Guarantee claim
MISAKI grants a 10-year guarantee against material and manufacturing defects. The full guarantee terms can be found here: 10-year guarantee.
This guarantee grants additional rights that exist independently of statutory warranty rights. Your statutory rights remain unaffected.
10. Data protection
AlpinePeak GmbH collects, stores and processes personal data exclusively for processing orders and in accordance with the applicable data protection provisions. Further information can be found in our privacy policy.
11. Applicable law and place of jurisdiction
Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from or in connection with this contract is Linthal, Switzerland, to the extent permitted by law.
12. Final provisions
If individual provisions of these GTC are invalid, the validity of the remaining provisions remains unaffected. The statutory provisions shall replace the invalid provision.
